The Consumer Protection Act 2019 replaced the old 1986 Act and strengthened consumer rights in India. It covers e-commerce, product liability, and unfair trade practices. It allows consumers to file complaints online via E-DAAKHIL portal. Penalties for misleading ads and product liability were significantly increased.

It is not legally mandatory to send a legal notice before filing a consumer complaint. However, it is strongly recommended as: it gives the company a chance to resolve the issue (15 days), it shows the court you made a good-faith effort, and it often results in quick resolution without going to the forum.
A consumer complaint must be filed within 2 years from the date the cause of action arose (i.e., from the date you experienced the problem or deficiency). The forum may condone delay if the consumer provides sufficient cause for the delay beyond 2 years.
You can claim: refund of product/service price, replacement of defective product, repair cost, compensation for mental agony and harassment (typically ₹5,000–₹50,000 for individuals), cost of litigation, and punitive damages in cases of unfair trade practices. Courts are generally liberal in awarding reasonable compensation.
